Laws Trends | Regulatory Requirements for Cybersecurity under the EU Radio Equipment Directive (2013/53/EU)

2024-09-10

1、Delegated Regulation (EU) on RED Network Security Requirements, March 30, 2022

Except for special products, Delegated Regulation (EU) 2022/30 stipulates that the following three types of wireless devices must meet the network security requirements specified in Article 3 (3) of the RED Directive:

  • Radio equipment for Internet connection

  • Wireless devices used for processing personal data, traffic data, or location data

  • Wireless devices used for transferring currency, currency value, and virtual currency

And it is stipulated that from August 1, 2024, these specific categories of radio equipment must comply with the network security requirements specified in the RED directive. However, due to the coordination of various departments around the standard, the implementation of this regulation has been postponed to August 1, 2025.

2、The newly released EN18031 series standards assist RED in network security assessment

With the widespread use of radio equipment, in order to improve the overall resilience of radio equipment to network security threats, the European Union's CEN/CENELEC Technical Committee on Network Security and Data Protection drafted and released the EN18031 series of standards for evaluating the network security requirements of specific categories of radio equipment, which was officially approved on August 1, 2024. This series of standards will be approved for inclusion in the EU OJ Bulletin as early as next year, officially becoming a coordinated standard for evaluating the network security requirements of the RED directive.

  • EN 18031-2: 2024 applies to wireless devices used for data processing to evaluate compliance with network security requirements in RED Art3 (3) e.

  • EN 18031-3: 2024 applies to wireless devices for transferring currency, currency value, and virtual currency, used to assess compliance with network security requirements in RED Art3 (3) f.
